How to Buy a Safe Lithium-Ion Battery in 2026: UL Marks, BMS Claims and Fire Safety

Start with the standard number, not the word “certified”. A lithium-ion battery pack for an e-bike, a scooter or a power tool is one of the few consumer purchases where the failure mode is a fire in your hallway, and the market is full of listings that gesture at safety without committing to anything checkable. Three things are worth doing before you buy, in this order: match the standard to the product, verify the certification in the certifier’s own database, and ignore the letters BMS entirely.

Two of those take about four minutes. The third saves you from the most common piece of reassurance in the category.

Which UL standard should the battery have?

It depends on what the battery goes in, and US regulators have now written the mapping down. The Consumer Product Safety Commission’s proposed federal rule, published on 24 June 2026, names three standards and says exactly which products each one covers.

In full, those are ANSI/CAN/UL 2849:2020 for the electrical system of an eBike, ANSI/CAN/UL 2272:2024 for personal e-mobility devices — e-scooters, e-skateboards, e-unicycles and hybrids — and ANSI/CAN/UL/ULC 2271:2023 for batteries used in light electric vehicle applications, which is the one that applies to a user-replaceable pack.

The distinction that matters to a buyer is between the pack and the system. UL 2271 certifies a battery pack on its own. UL 2849 certifies the battery, charger, motor and controller as one combination. An e-bike sold with a UL 2271 pack has a certified battery in an uncertified system; the charger and the controller are part of how batteries catch fire, and they are what UL 2849 adds. If a seller quotes 2271 for a complete e-bike, that is not a lie, but it is not the whole answer either.

What does a “UL” claim on a listing actually mean?

Often nothing, because the useful phrases and the meaningless ones look alike. “UL Listed” and “UL Certified” mean a finished product was tested by UL and the manufacturer is authorised to carry the mark. “UL Recognized” applies to a component destined to go inside something else, judged under conditions rather than as a standalone product. And “tested to UL standards”, “meets UL 2271” or “UL-compliant” are marketing sentences that anybody can type, including a manufacturer who tested in its own lab or who tested and did not pass.

The way out of this is not to parse the wording harder. It is to check.

UL runs a public database, Product iQ, which is free for basic searches after registration. You can search by company name, by model number, or by the manufacturer’s UL file number — the code beginning with E that a genuinely certified product will be able to give you. If a seller cannot produce a file number, or the number does not resolve to that company and that product, you have your answer without needing to interpret a single adjective.

That is the whole verification routine: get the file number, look it up, confirm the company and product match. It takes about two minutes and it is the only step in this article that cannot be faked by the person selling to you.

Does a BMS make a battery safe?

No, and the claim is not checkable, which is the real problem with it. A battery management system is the electronics that watch each cell and cut in when something is wrong: stopping the charge when a cell rises above its safe voltage, stopping the discharge when it falls too low, disconnecting on a short circuit or excess current, and blocking charging at temperatures where lithium plating starts. All of that is real and necessary, and a pack without it would be dangerous.

The trouble is that “has a BMS” appears on effectively every listing in the category, there is no BMS mark, and no database of them exists. Two packs can both truthfully claim a BMS while one has protection that trips reliably and the other has a circuit that has never been tested against a failing charger.

This is where certification and BMS claims meet, and it is the answer to the question the title asks. The abuse tests in the battery standards — overcharging the pack past its normal voltage, shorting the terminals, thermal and mechanical abuse — are precisely the tests that force the protection circuitry to demonstrate it works. A certified pack is one whose BMS has been made to prove itself in front of a third party. An uncertified pack with a BMS is a claim about a component nobody outside the factory has watched operate.

So the practical rule is short: do not evaluate the BMS. Evaluate whether anyone independent has tested the pack that contains it.

Is any of this required by law?

In New York City yes, nationally in the US not yet, and in the UK not at all. Those three answers are different enough that where you live changes what you can rely on.

New York City’s Local Law 39 of 2023 has required since September 2023 that e-bikes, e-scooters and their batteries sold, leased or distributed in the city be certified to the relevant standard, with the certification shown on the device, packaging or documentation. Later laws gave the city power to close repeat-offending retailers.

Nationally, the CPSC’s June 2026 proposal would make those same standards mandatory across the US for e-bikes, e-scooters, hoverboards, skateboards, unicycles, replacement packs, aftermarket chargers and conversion kits. It is still a proposal: comments close on 24 August 2026 and a final rule would follow later. Until then, outside New York, certification is something you have to check for rather than something you can assume.

In the UK there is no equivalent requirement. Government consumer guidance points buyers to CE or UKCA marking, the Office for Product Safety and Standards has issued statutory guidelines aimed at businesses under the General Product Safety Regulations 2005, and a British Standards Institution specification for these battery systems is still being developed. A UK buyer looking for a UL mark is applying a US framework to a market that does not require it — useful as a signal of quality, but not something British sellers are obliged to provide.

What do the fire numbers actually show?

That the fires did not stop. The deaths did. New York is the only place with several years of consistent public data, and the pattern in it is not the one you would expect.

Battery fires went slightly up between 2023 and 2024 while deaths fell by two thirds, and then to a single death in 2025. Something changed, and it was not the number of batteries failing.

Part of the answer is in a second number the fire department gave: non-structural fires — ones that happened outdoors rather than inside an apartment, a home or a business — rose from 90 in 2023 to 133 in 2024. More of the failures were happening somewhere that did not trap anybody. Officials credit a combination of enforcement and public education alongside the certification law, and it is worth being honest that the certification rule is one of several things that changed at once.

For a buyer, the useful reading is blunt. Certification lowers the chance that your pack is one of the ones that fails. Where you charge it decides what happens if it does. Those are two separate defences and the second one is free.

How should I charge and store it?

Follow the manufacturer’s charger and stay awake. The advice below is the UK government’s own guidance for e-cycle users, published in February 2024, quoted rather than paraphrased because inventing safety advice is not something we do.

Use only the charger supplied with the product. Do not overcharge the battery. After heavy use, let the battery cool before charging it. Charge “only while you’re awake and alert” and do not leave batteries charging while you are asleep. Do not cover chargers or battery packs while charging, keep them out of direct sunlight when not in use, and do not overload sockets or extension leads.

On buying, the same guidance is equally direct: it is safest to buy a complete product with its battery and charger included from a reputable retailer, and to register it with the manufacturer. For replacements, buy “only genuine items authorised by the e-cycle or drive system manufacturer”, and be cautious about used battery packs. On conversion kits, it warns that if you buy packs and chargers separately “it’s impossible to be sure they are compatible” — which is the same point the UL 2849 versus UL 2271 distinction makes, arrived at from the other direction.

Dispose of a dead pack through the manufacturer’s free take-back service or a local recycling arrangement. Never in household waste or ordinary recycling.

What are the warning signs a battery is about to fail?

Heat, swelling, noise, smell and a change in charging behaviour — and any one of them means stop using it. Again, this is the UK guidance’s own list.

A battery that “feels extremely hot to the touch” may be defective. A pack “bulging or swelling out of shape” is a common sign, as are lumps or leaks — stop using it immediately. Failing lithium batteries “have been reported to make hissing or cracking sounds”. A strong or unusual smell, which may be toxic, is a warning. So is a battery that fails to charge fully or starts taking longer than it used to.

And the last line on that list is the one to remember: if your battery or device is smoking, a fire has already started. That is not an early warning. Get out and call the fire service.

How we verified this

The standard-to-product mapping is taken from the federal rulemaking text, not from retailers. The CPSC’s notice of proposed rulemaking published on 24 June 2026 (91 FR 38162, docket CPSC-2025-0012) names ANSI/CAN/UL 2849:2020 for eBikes, ANSI/CAN/UL 2272:2024 for other micromobility products, and ANSI/CAN/UL/ULC 2271:2023 for user-replaceable battery packs. We read that document directly because vendor explanations of which standard covers what are inconsistent with each other.

The CPSC incident figures are quoted as the Commission states them. From 2019 through 2023 the CPSC says it is aware of 227 unique incidents that the proposed rule could potentially have prevented; 90 of those incidents are associated with 39 fatalities and 181 injuries.

The proposal is a proposal. As of 13 August 2026 nothing in it is binding. Comments are due 24 August 2026, and any final rule and effective date would come later. The article says so rather than implying the requirement already exists nationally.

The New York figures come from the fire department, not from the standards body. ULSE, which develops the UL standards, has published its own account of the same decline; because it is an interested party we used the FDNY numbers reported through the city and its council instead: 268 fires and 18 deaths in 2023, 277 fires and 6 deaths in 2024, and one death in 2025. FDNY has not published a full-year 2025 fire count, so we do not give one.

We attribute the cause of that decline rather than asserting it. Officials credit enforcement and education alongside the certification law. The article reports the correlation and the officials’ explanation; it does not claim the law alone caused the fall.
